Applications for compassionate release must be lodged with the Australian Taxation Office (ATO), which assesses each application against legislated criteria. If approved, the ATO issues a determination allowing your super fund to release the funds.

Who qualifies?

Eligibility is assessed by the ATO on a case-by-case basis. Generally, the treatment needs to address a serious condition, and procedures that are purely cosmetic are not eligible.
